WAIVER 

This is a copy of our Waiver which is required to be authorized when registering your child for class(es). Provided here as a reference.

As legal guardian of my designated student(s) (student(s)), I hereby consent to all student(s) participating in this facility's program(s). I recognize that potentially severe injuries can occur in any activity involving height or motion, including tumbling and related activities such as cheerleading, tumble tramp, trampoline, stunting, pyramids, dance, swimming, martial arts, gymnastics and physical activity in general. I understand that it is the express intent of all staff and personnel to provide for the safety and protection of my student(s) and, in consideration for allowing my student(s) to use these facilities, I hereby COVENANT NOT TO SUE and FOREVER RELEASE this facility, affiliated and partner companies and organizations, property owners and lessors, staff, contractors, subcontractors, teachers, coaches, owners, directors and other members involved in this facility's program(s), from all liability and for any and all damages and injuries suffered by my student(s) during instruction, supervision, and/or control during any and all classes or extra activities.

  • Participant is currently medically and physically able to partake in all classes or activities at Electric Avenue Acro. I will notify Electric Avenue Acro of any changes in the medical condition of my child. In consideration of participating in the programs at Electric Avenue Acro, I understand the nature of the activity and that I and/or my child is qualified, in good health, and in proper physical condition to participate in such activity.

  • In case of emergency, I authorize employees of Electric Avenue Acro to contact and/or secure medical attention for my student.

  • I hereby release, discharge, and covenant not to sue Electric Avenue Acro, its respective administrators, directors, agents, officers, volunteers, owners and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the activity takes place, (each considered one of the “releasees” herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the “releasees” or otherwise, including negligent rescue operations and further agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the “releasees” from any loss, liability, damage, or cost, which any may incur as the result of such claim.

  • I fully understand and acknowledge that there are risks and dangers associated with participation in gymnastics/fitness activities and events, including but not limited to bodily injury, partial and/or total disability, paralysis and death; and accept and assume such risks and responsibilities for the losses and/or damages.

  • If either party should undertake legal action to enforce any of the terms of this agreement, the prevailing party therein shall be entitled to reasonable attorney’s fees and costs of suit incurred in connection therewith, in addition to any other relief awarded.

  • This agreement shall be governed by and construed in accordance with the laws the state of Texas without giving effect to the principles of conflicts of law. The exclusive jurisdiction and venue of any action arising under this agreement shall be the District Court of Travis County.

  • A determination by a court of competent jurisdiction that any provision of this agreement or any part thereof is illegal or unenforceable shall not cancel or invalidate the remainder of such provision or disagreement, which shall remain in full force and effect.

  • I agree that this waiver and release agreement covers each and every activity at Electric Avenue Acro and releasees are released as to each and every time the participant comes to Electric Avenue Acro.

  • I understand that media such as photographs and/or videos of participants may be taken and used for Electric Avenue Acro’s official use and display. My child’s last name will not appear alongside any media type parental consent.

  • I agree to follow the rules, regulations, and policies when participating within the programs of Electric Avenue Acro.

  • I give permission to Electric Avenue Acro to send updates and/or promotions through mail, email or text message at any time.
